  Former Teacher Arrested for Receiving and Possessing Child Pornography

The following information was released by the United States Attorney's Office for the Western District of Kentucky:

Ronald Borman, age 61, of Taylorsville, Kentucky, in Spencer County, was arrested yesterday on a federal arrest warrant. Borman had been charged in a Criminal Complaint filed in United States District Court in Louisville with several instances of receiving and possessing child pornography, U.S. Attorney David L. Huber announced today. Borman came to the attention of the Louisville Metro Police Department (LMPD) Crimes Against Children Unit (CACU) in 2006 when a detective from a Florida Internet Crimes Against Children Task Force contacted the agency for assistance in its investigation against Borman for on-line enticement.

The Affidavit

According to the Affidavit of a detective with LMPD's CACU, filed in federal court, a forensic examination of Borman's computer revealed 304 still images and 24 movie files containing child pornography. A sampling of child pornography images recovered from Borman's computer included the following:

a. Still image received via e-mail on February 8, 2006, at 4:46 p.m. The image depicts an adult male penis vaginally penetrated a young female child (approximately 6-8 years of age). The child's face is not shown. However, her body frame is very small, including the upper part of her thighs and her right hand. There is no pubic hair on the child's body;

b. Still image received via e-mail on June 23, 2006, at 12:42 p.m. The images depicts two young males (approximately early teens) lying on a bed. Both males are nude. One male is lying on his back while the other is lying on his stomach performing oral sex on the male lying on his back;

c. Still image received via e-mail on June 23, 2006, at 6:45 p.m. The image depicts a nude adult male. A young male child (approximately 4-6 years of age) is shown holding the man's erect penis with his right hand. The man's penis is in the child's mouth; and

d. A movie file downloaded from America Online and saved to Borman's "my documents" on March 2, 2006. The movie has a playing time of 46 seconds. It depicts two young children (approximately 9-11 years of age). The two children are shown performing oral sex on an adult male.

On August 10, 2006, a CACU Detective received a phone call from Detective Michael Folk of the Clearwater Police Department in Florida, a member of an Internet Crimes Against Children Task Force. At the time, Detective Folk was working an investigation against a person named Ronald Borman. During his investigation, Detective Folk utilized an undercover profile which depicted him as a young male juvenile. While chatting on America Online and Yahoo! instant messenger, Borman appeared nude on a webcam and performed sexual acts for the "juvenile" (actually the undercover detective). In addition to sex, Borman also discussed drug usage and appeared on his webcam smoking a pipe of marijuana. Considering the fact that Borman lived in Louisville, Detective Folk requested assistance with the investigation from LMPD.

On August 10, 2006, the LMPD CACU Detective sent a Jefferson County Grand Jury Subpoena to Insight Communications to verify the personal information for Borman. The response from Insight Communications confirmed that Borman was the person who had chatted with Detective Folk. The information was provided to Detective Folk to assist the Florida investigation.

On October 10, 2006, Detective Folk called the LMPD CACU Detective and informed him that an arrest warrant for "Seduction of a Child via Internet" had been issued for Borman. The next day, law enforcement officials arrested Borman on the warrant issued from Florida. Law enforcement officials arrested Borman at the Jefferson County Public Schools' VanHoose Education Center. Jefferson County Public Schools' security personnel assisted the CACU Detective by calling Borman to their office at the VanHoose Education Center in order to avoid unnecessary exposure of the situation to school students. At the time of his arrest, Borman worked as a teacher for Jefferson County Public Schools.

After explaining the situation to Borman, the CACU Detective asked Borman for consent to search Borman's apartment. Borman cooperated and gave consent to search the apartment. During the search of the apartment several items of pornography were found, including items referencing children. Law enforcement officials seized a computer, webcam, and additional computer equipment. Officials also located and seized marijuana and the exact marijuana pipe Borman had smoked while on the webcam with Detective Folk.

The CACU Detective submitted the computer evidence for examination at the Kentucky Regional Computer Forensic Laboratory. As noted above, the examination revealed 304 still images and 24 movie files containing child pornography, including 31 e-mail messages that contained 283 still images of child pornography. Many of the images were retrieved from folders on the computer which contained e-mails Borman had received from other individuals. The images were attached to the e-mail messages.

Florida law enforcement officials prosecuted Borman for violating Florida Statute 847.0135, seduction of a child via computer, in Pinellas County Florida Circuit Court Number CRC 06-22565CFANO-A. Borman entered a plea of nolo contendere to the charge. On August 21, 2007, the Circuit Court judge sentenced Borman to 21 months' imprisonment.

In the event of a conviction on the federal child pornography charges, Borman faces a mandatory minimum term of imprisonment of 5 years. (The mandatory minimum can be increased due to a prior conviction and can be as much as 15 years). The maximum potential penalties include 160 years' imprisonment, a $1,000,000.00 fine, and supervised release for a period of at least 5 years and could include life.

Borman appeared before United States Magistrate Judge Dave Whalin for an initial appearance hearing at 2:30 p.m. today in Louisville, Kentucky. The matter will be scheduled for a preliminary hearing and detention hearing to be held on October 30, 2008, at 1:00 p.m., in Louisville, Kentucky.
